CAT approach to opt-out claims defended, amid calls for class rep clarity

Dame Kelyn Bacon, president of the UK Competition Appeal Tribunal, said opt-out collective actions remain important for access to justice but will face closer CAT scrutiny on merits, proportionality, funding arrangements, funder returns and class representative independence to ensure lawyers and funders are not persistently the main beneficiaries.
