The team at Herbert Smith Freehills shares that Germany has implemented the EU Representative Actions Directive, introducing stricter requirements for litigation funding, including a ban (with exceptions) on litigation funding where the funder is promised an economic share of more than 10% of the service to be provided by the defendant.
