A decade after the UK introduced opt-out competition class actions, filings have dropped sharply as litigation funders pulled back following the Supreme Court’s PACCAR ruling, though expected legislative reversal of that decision and recent claimant wins such as Kent v Apple are reviving funder interest in financing large consumer competition claims before the Competition Appeal Tribunal.
