Court of Appeal rules Bench Walk-backed claim should proceed

Bench Walk Advisors and another funder had funded competing claims in the Competition Appeal Tribunal relating to price manipulation in the FX markets. The tribunal had ruled in March 2022 that neither of the competing claims should be certified on an “opt out” basis. This morning the Court of Appeal overturned that decision and ruled that the claim funded by Bench Walk should be certified, clearing the way for Bench Walk’s funded claim to proceed.
