Bronwyn Martin of Moodie Mair Walker warns that, with adverse costs policies becoming more common partly through the growth of third-party litigation funding, lawyers should take heed of a recent Ontario Court decision rejecting an argument that an adverse costs policy didn’t need to be produced on the basis of privilege.
