Terry Dee, Kyllan Gilmore and Michael Hill of Winston & Strawn examine the potential impact of AI on litigation funding, concluding that the outcome is almost certain to be more litigation as funders identify claims that otherwise would not have been brought, match those claims with lawyers performing that type of work, and fund the case. They also conclude that smaller-dollar cases, which previously would not have provided a sufficient return on investment, will become more attractive when AI is capable of identifying and analyzing them without human intervention.
