Ellis v Commonwealth of Australia [2023] NSWSC 550 (25 May 2023)

The Supreme Court of New South Wales has approved a settlement in the Stolen Generations class action, including Litigation Lending’s 12.88% cut of the settlement proceeds, which the judge referred to as “relatively modest" on “any view of prevailing market rates for funders’ commissions and having regard to the real benefits group members will derive from the settlement.
