Grassley Proposes Third-Party Litigation Funding Reform, Foreign Reporting Requirements

Senators Grassley, Kennedy, Tillis and Cornyn introduced the Litigation Funding Transparency Act of 2026 last week. The legislation would require disclosure of third-party litigation funding, as well as the underlying funding agreements, in federal class actions and federal multi-district litigation proceedings, and would prohibit funders from being able to control decision-making or the overall activities in the litigation.
