Harbour Underwriting issues cross-undertaking in damages policy to help secure worldwide freezing injunction

Rocco Pirozzolo of Harbour Underwriting reports that in a recent case where a claimant was seeking a worldwide freezing injunction over shares held by some of the defendants, the court accepted a unique insurance policy in place of a cross-undertaking in damages and predicts that this type of policy will become requested more often as litigators and litigation funders become aware of its availability.
