A Research Brief on Litigation Risk Transfer, Based on a Survey of Corporate Legal Leaders

Certum Group recently surveyed 44 in-house litigation attorneys about how they assess and manage litigation risk. The results show a significant gap between awareness and adoption of litigation risk transfer among corporate legal departments, with roughly 70% of surveyed in-house lawyers familiar with litigation funding but only about 6% having used it, even as 51% would consider using funding in the future and cost certainty, budget constraints and time pressures emerge as key adoption drivers.
