Insurers’ Fight with Litigation Funders Hits Liability Policies

Commercial liability insurers may soon be able to force disclosure of third-party litigation funding arrangements after the Insurance Services Office, a unit of Verisk Analytics Inc., released optional policy language that would require policyholders to reveal funding tied to claims disputes, escalating tensions between carriers and litigation funders in mass tort litigation.
