JUDD -v- AUSTRALIAN SECURITIES & INVESTMENTS COMMISSION [2026] WASC 360 (26 August 2026)

The Supreme Court of Western Australia approved the discontinuance of a representative action against ASIC over alleged regulatory failures relating to the Sterling Group after the plaintiff was unable to secure litigation funding from several funders, finding that discontinuance would not unfairly prejudice potential group members, who had not been identified or notified and remain free to pursue their own claims.
