LexCapital, securitization to finance litigation investments

Italy’s LexCapital has completed one of the country’s first litigation funding securitizations, partnering with a domestic institutional investor to finance a portfolio of legal claims through a segregated asset structure, while paving the way for reverse litigation funding solutions (where third-party funders finance defendants’ litigation costs in exchange for a share of the resulting economic benefit) to help insurers and run-off operators manage long-tail liabilities.
