The New South Wales Supreme Court rejected the latest claim brought by funder Litigation Fund WCX in the WestConnex class action as an abuse of process, finding the funder had already pursued—and failed to establish—its asserted funding agreements in earlier proceedings and could not re-litigate the same funding dispute through serial actions.
