Litigation funder Burford wins US court challenge to $50 million Sysco settlement

A US appeals court ruled that a $50 million antitrust settlement between Sysco and Pilgrim’s Pride was never final, siding with Burford, which invested about $140 million to back the claims, later acquiring the litigation rights through an affiliate. Burford objected to the proposed $50 million settlement on the grounds that it materially undervalued the antitrust claims relative to their potential recovery, was reached without agreement on key commercial terms, and would have extinguished litigation it had heavily financed without delivering a return commensurate with the risk and capital invested.
