More Litigation Funding Rules Would Threaten Access to Justice

Erick Robinson of Spencer Fane argues that requiring every aspect of the funding relationship to be made public wouldn’t achieve fairness, pointing out that required disclosure of a litigation budget in a funding agreement would give a defendant an advantage over the plaintiff by revealing the exact dollar amount it would take to win the litigation based on attrition rather than legal merits.
