Litigation Lender backs class action over Melbourne flooding

Litigation Lending is backing a proposed class action against Melbourne Water Corporation over alleged negligence linked to flooding at a Melbourne retirement village, adding to a growing pipeline of infrastructure-related claims supported by litigation finance in Australia.
The proceeding, filed on January 14, 2026, has been brought by Mayweathers together with William Roberts Lawyers on behalf of residents of the Rivervue Retirement Village who suffered loss and damage following flooding of the Maribyrnong River in October 2022. The residents allege that Melbourne Water’s conduct contributed to the flooding through the production and use of faulty or inadequate flood modelling, as well as through its processes for approving lower finished floor levels for the Rivervue development. The claim asserts that these approvals exposed the property to an elevated risk of flooding during extreme weather events.
The alleged losses include economic loss, diminution in the value of residents’ leasehold interests, and non-economic loss in the form of disappointment and distress arising from the flooding and its aftermath.
The class action is open to current and former holders of leasehold interests in residential properties at the Rivervue Retirement Village on or after October 14, 2022, who allege they suffered loss or damage as a result of Melbourne Water’s conduct. Eligible residents are being invited to register their interest as potential group members.
