Litigation Lending Services backs discrimination claim against State of Queensland

Litigation Lending Services is funding a class action filed by JGA Saddler against the State of Queensland, on behalf of Aboriginal and Torres Strait Islander peoples who allege racial discrimination in the delivery of healthcare services across Far North and Northwest Queensland.

The claim alleges that the State of Queensland, through the North West Hospital and Health Service (NWHHS) and the Torres and Cape Hospital and Health Service (TCHHS), unlawfully prevented Aboriginal and Torres Strait Islander communities from accessing healthcare in a manner consistent with their human rights and fundamental freedoms, in breach of the Racial Discrimination Act 1975.

For a period of almost 30 years, class members are said to have experienced discriminatory conduct including overt racism or subconscious bias; inadequate medical assessment, monitoring and observation; clinical interventions, such as the provision of temporary and low-level pain relief in the place of more involved intervention; and unsafe and unsupportive patient support (for example, by the use of metal grilles).
