Major report rejects regulation of third-party litigation funding
A report by the European Law Institute has rejected a scheme of comprehensive regulation for litigation funding, concluding that there should only be a move to regulate litigation funding in the event of “an identifiable problem or market failure”, and instead proposing a set of principles, supported by suggested minimum content, for funding agreements.
