Malaysia ushers in revamped third-party funding framework

Malaysia has brought a comprehensive statutory regime for third-party funding in arbitration into force from 1 January 2026, expressly legalising and regulating TPF through mandatory disclosure and a new code of practice, while parallel reform momentum continues in the UK as the UK Ministry of Justice moves to unwind post-PACCAR uncertainty around the enforceability of litigation funding agreements.
