Merricks v Mastercard – landmark settlement or Pyrrhic victory?

The UK CAT’s approval of a £200 million settlement in the landmark collective action against Mastercard has sparked a heated debate between funder Innsworth and class representative Walter Merrick, represented by Willkie Farr, including arguments made by Innsworth and other funders that the 0.5x return Innsworth ultimately received was insufficient given the risks it assumed, and that the decision will have a chilling effect on the funding of opt-out collective actions.
