Pogust Goodhead co-founder wades into Mariana dam representation dispute

The escalating fight over control of the 400,000-claimant Mariana dam litigation against BHP is increasingly exposing the funding, insurance and contractual complexities of changing counsel mid-case: Pogust Goodhead is challenging a client committee’s attempt to move the claims to Bailey Glasser International and Hausfeld, warning of consequences for existing litigation funding and ATE arrangements, while BGI says the switch is intended to protect the litigation from inappropriate funder influence.

The dispute has also drawn in PG co-founder Harris Pogust, who says he wants his name removed from the firm over its handling of the representation battle, while Quinn Emanuel has strengthened the PG team with London senior partner Richard East ahead of a High Court hearing that will determine who represents the claimants for the £36 billion damages phase.
