Show me the money: why recovery risk is underestimated in the arbitration market

Max Odenthal of Gordian Special Assets looks at a new academic study suggesting that the level of voluntary compliance with international commercial arbitral awards (i.e. not requiring active pursuit of enforcement in national courts, asset identification, etc) is grossly overestimated by experts in the field and urges claimants and their litigation funders to ensure that they appropriately factor enforcement into their budgeting and financial modelling for pre-award commercial arbitration claims.
