The CJC proposals for litigation funding reform seek to promote access to justice alongside ‘fair and proportionate’ regulation

The Civil Justice Council has published its final report on its recommendations for reform of the litigation funding sector, emphasising the importance of reversing the PACCAR decision through urgent legislation as a first priority, and then proposing “a raft of other measures” to be introduced through separate legislation. Notably, the working party rejected the introduction of caps on litigation funders’ returns.
