The London Disputes Report: How UK GCs and Law Firms are Approaching Commercial Litigation and Arbitration in 2026

Burford Capital and The Lawyer’s survey of senior UK lawyers found that 67% believe strong claims often go unpursued because of cost or risk, 85% say legal finance and other risk-transfer tools improve litigation decision-making, and 73% report direct experience with legal finance, as boards increasingly assess disputes through the lens of cost, recoverability, and return on investment.
