The Supreme Court of Western Australia in a long-running family mining dispute has ordered several non-party funders and funding facilitators, including Litigation Funding Solutions, to be jointly and severally liable for the defendants’ trial costs, estimated at about $5.76 million, after finding they had sufficient connection to the failed litigation and stood to receive substantial commercial upside if the claim succeeded.
